Welcome to Optimy Cleaner. These Terms of Service ("Terms", "Terms of Service") govern your access to and use of the Optimy Cleaner mobile application ("Optimy Cleaner", "Application", "Service", "we", "us", or "our"). By downloading, installing, or using the Application, you agree to be bound by these Terms. If you do not agree to all of these Terms, you must immediately discontinue use of the Application.
By accessing or using the Application, you acknowledge that you have read, understood, and accepted these Terms in full. You further agree that your use of the Application constitutes a legally binding agreement between you and Optimy Cleaner.
You may not use the Application if you do not have the legal capacity to form a binding contract under applicable law.
You must be at least 13 years of age (or the minimum age required by your jurisdiction) to use the Application. By using the Application, you affirm and warrant that you meet the age requirement and have the legal authority to enter into these Terms.
Optimy Cleaner reserves the right to refuse access to any individual who does not meet the eligibility requirements or violates these Terms.
Subject to your compliance with these Terms, Optimy Cleaner grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the Application on a compatible device for personal, non-commercial purposes only.
This license is conditioned upon your adherence to all applicable laws and these Terms. Unauthorized or prohibited uses include, but are not limited to:
Failure to comply with these restrictions may result in immediate termination of your license and access.
Optimy Cleaner offers a three-day free trial followed by optional paid subscriptions. Subscription payments are processed exclusively through Apple’s App Store platform. We do not access, store, or transmit your payment information.
By subscribing, you agree to pay all applicable fees and taxes. Subscriptions are automatically renewed unless canceled prior to the renewal date through your App Store account settings.
Refunds are governed by Apple’s refund policy and applicable consumer protection laws. Optimy Cleaner reserves the right to modify subscription fees with advance notice.
As a user, you are responsible for your use of the Application, including any consequences arising from:
You agree not to use the Application in any way that could damage, disable, or impair any part of the Application or the devices of other users.
Optimy Cleaner, its affiliates, directors, officers, employees, agents, and licensors shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to:
Your use of the Application is at your sole risk. This limitation applies regardless of the form of action, whether in contract, tort, or otherwise.
The Application is provided on an "as-is" and "as available" basis. Optimy Cleaner makes no warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted service.
We do not guarantee that the Application will be free of errors, operate without interruption, or achieve any specific results.
We reserve the right to suspend or terminate your access to the Application at any time for violations of these Terms or other policies. Upon termination, all rights granted to you under these Terms immediately cease.
Termination does not affect accrued rights, obligations, or liabilities incurred prior to termination.
All intellectual property rights, including copyrights, trademarks, trade secrets, and patents in the Application, remain the exclusive property of Optimy Cleaner or its licensors. Users are prohibited from copying, distributing, or using these rights without express permission.
Your use of Optimy Cleaner is also governed by our Privacy Policy, which details how information is collected, processed, and protected. By using the Application, you consent to the practices described therein.
Optimy Cleaner may update these Terms periodically. Updates will be communicated via the Application, website, or App Store listing. Continued use of the Application after such updates constitutes acceptance of the new Terms.
These Terms are governed by the laws of the jurisdiction in which Optimy Cleaner operates, without regard to conflict of laws principles. Any disputes arising from these Terms shall be resolved through binding arbitration or through the appropriate court if arbitration is not available.
You agree that any claim related to the Application must be filed within one (1) year from the date the cause of action arose. Otherwise, the claim is permanently barred.
These Terms, together with the Privacy Policy and any additional legal notices published by Optimy Cleaner, constitute the entire agreement between you and Optimy Cleaner regarding the Application and supersede all prior agreements or understandings.
By using Optimy Cleaner, you acknowledge that you have read, understood, and agree to these Terms of Service in full.
